Secured Parking & Storage Lot – Dump Truck Parking Terms and Conditions
These Parking Terms and Conditions ("Agreement") govern the rental and use of parking spaces for dump trucks and related commercial vehicles at The Worxshop (operated by AthensWorx/Sequential Gears Holding Company) ("Owner," "we," or "us"). By renting or using a parking space in the secured parking and storage lot ("Lot"), the renter ("Renter," "you") agrees to comply with the following terms.
1. Use of Parking Space
Parking spaces are provided solely for the parking and storage of dump trucks and related work vehicles approved by the owner.
Vehicles must be in operable condition unless otherwise approved in writing.
Parking spaces may not be used for vehicle repair, maintenance, washing, fueling, loading/unloading materials, or any commercial activity beyond parking and storage.
Subleasing or sharing of parking spaces is strictly prohibited without prior written consent from the owner.
2. Access to the Lot
The Lot is accessible 24 hours a day, 7 days a week via a secured, hand-locked gate.
Renter is responsible for properly locking the gate after each entry or exit.
Access credentials, keys, or lock combinations are issued for Renter’s use only and may not be shared.
The owner reserves the right to change access procedures or locks for security reasons, with reasonable notice when possible.
3. Prohibited Materials & Safety Requirements
To maintain a safe and compliant facility, the following are strictly prohibited:
Hazardous Materials: No hazardous, toxic, flammable, explosive, corrosive, or environmentally harmful materials may be stored, transported, leaked, or left in any vehicle while parked in the Lot. This includes, but is not limited to:
Fuel containers (other than the vehicle’s standard fuel tank)
Chemicals, solvents, or oils in bulk
Asbestos, medical waste, or regulated waste
Leaks & Spills: Vehicles must not leak fluids of any kind. Any spill must be reported immediately and cleaned at Renter’s expense.
Idling: Excessive idling within the Lot is prohibited.
Firearms & Illegal Items: No illegal substances, stolen property, or prohibited weapons may be stored or left on the premises.
The owner reserves the right to immediately remove or deny access to any vehicle found in violation of this section.
4. Compliance With Laws
Renter is solely responsible for ensuring compliance with all federal, state, and local laws, regulations, and ordinances, including environmental and transportation regulations.
The owner assumes no responsibility for monitoring Renter’s compliance with such laws.
5. Insurance & Liability
Renter must maintain valid commercial auto insurance covering all vehicles parked in the Lot.
The owner is not responsible for loss, theft, damage, vandalism, or acts of nature affecting vehicles or their contents.
Parking is provided at Renter’s sole risk.
6. Indemnification
Renter agrees to indemnify, defend, and hold harmless Owner, its members, managers, employees, agents, and affiliates from and against any and all claims, damages, losses, penalties, fines, environmental remediation costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
Renter’s use or misuse of the Lot
Any hazardous or prohibited materials brought onto the Lot
Any spill, leak, or environmental contamination caused by Renter’s vehicles
Renter’s violation of this Agreement or applicable Georgia law
This obligation shall survive termination of this Agreement.
7. Security & Surveillance
The Lot is secured but not continuously monitored unless expressly stated otherwise.
Any cameras or security measures are for deterrence purposes only and do not create a duty to protect Renter’s property.
8. Fees, Payment & Termination
Rental fees are charged according to the pricing schedule provided by The Worxshop (AthensWorx/Sequential Gears Holding Company LLC) at the time of enrollment or renewal. Fees may be billed monthly in advance unless otherwise agreed in writing.
Payments are due on the invoice due date. Late or unpaid balances may result in suspension of gate access.
The owner reserves the right to change pricing upon reasonable written notice.
The owner may immediately terminate this Agreement for non-payment, safety violations, or the presence of prohibited or hazardous materials.
Upon termination, Renter must remove all vehicles from the Lot within twenty-four (24) hours unless a shorter period is required for safety or legal compliance.
9. Right to Remove Vehicles
Owner reserves the right to tow or remove any vehicle, at Renter’s expense, that:
Violates these Terms
Poses a safety or environmental risk
Is parked without authorization
10. Limitation of Liability
To the fullest extent permitted by law, Owner’s liability is limited to the amount of parking fees paid by Renter during the preceding month. The owner shall not be liable for indirect, incidental, or consequential damages.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.
12. Acceptance of Terms
Use of the Lot constitutes acceptance of these Terms and Conditions. The owner reserves the right to update these terms with reasonable notice.
